PARTIES
This Agreement is entered into between Amado Clinic Aesthetic ("the Clinic") and the undersigned individual ("the Client"), who by signing this document acknowledges having read, understood, and agreed to all terms and conditions set forth herein.
1. MEMBERSHIP BENEFITS
1.1 The membership may include, but is not limited to: discounts on aesthetic treatments, preferential scheduling access, monthly or periodic included services, and exclusive promotions for active members.
1.2 The specific benefits granted to the Client shall correspond exclusively to the membership plan selected at the time of enrollment, which shall have been clearly disclosed and explained prior to purchase.
1.3 Amado Clinic reserves the right to modify, update, or substitute membership benefits at its sole discretion, provided that reasonable prior notice is given to the Client.
2. BILLING AND PAYMENT TERMS
2.1 Membership plans are available on a monthly, quarterly, or annual basis, as selected by the Client at the time of enrollment.
2.2 By entering into this Agreement, the Client authorizes Amado Clinic to automatically charge the applicable membership fee on a recurring basis to the credit card registered in the Client's file.
2.3 The Client accepts the applicable monthly discount rate according to the selected plan and assumes full responsibility for maintaining a valid and current payment method on file at all times.
2.4 In the event of a declined, failed, or late payment, Amado Clinic reserves the right to immediately suspend the Client's membership benefits until the outstanding balance is resolved.
2.5 The Client shall be notified of any payment failure and given a reasonable opportunity to update their payment information. Repeated payment failures may result in permanent membership termination.
3. CANCELLATION POLICY
3.1 All membership fees are non-refundable. No reimbursement shall be issued for any membership period already billed, regardless of service utilization.
3.2 Cancellation requests must be submitted in writing to Amado Clinic no less than thirty (30) days prior to the next billing cycle, in accordance with the contracted plan.
3.3 Unused benefits, services, or credits shall not accumulate, carry over, or be transferred to subsequent billing periods or to any other individual.
3.4 In the event that the Client cancels their membership while an active treatment is in progress, the Client shall be responsible for paying the full retail price of said treatment, without application of any membership discount.
3.5 Amado Clinic reserves the right to modify, suspend, or terminate any membership plan with prior written notice to the Client.
4. MEDICAL EVALUATION AND SCOPE OF SERVICES
4.1 All services included under the membership plan are subject to prior medical or aesthetic evaluation by a licensed provider, where applicable, and may be declined if deemed medically inappropriate.
4.2 The Client acknowledges that individual results may vary and that no specific outcome is guaranteed as a result of any treatment received under this membership.
4.3 Certain treatments may require the execution of additional, procedure-specific informed consent forms prior to the provision of services.
5. CLIENT HEALTH DISCLOSURE
5.1 The Client declares that all health information provided to Amado Clinic is accurate, complete, and truthful, including but not limited to: pre-existing medical conditions, known allergies, current medications and supplements, pregnancy status, and breastfeeding status.
5.2 The Client acknowledges that omission of relevant health information may directly affect the safety and outcome of treatments received, and releases Amado Clinic from any liability arising from such omission.
6. LIMITATION OF LIABILITY
6.1 Amado Clinic and its staff shall not be held liable for adverse outcomes resulting from the Client's failure to disclose accurate and complete health information as outlined in Section 5.
6.2 The Clinic shall not be held responsible for any indirect, incidental, or consequential damages arising from the suspension, modification, or termination of membership benefits.
7. GOVERNING LAW
7.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States of America.
7.2 Any dispute arising from this Agreement shall first be subject to good-faith negotiation between the parties. If unresolved, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida.
8. ACKNOWLEDGMENT AND AUTHORIZATION
By signing below, the Client confirms that they have fully read and understood this Agreement, voluntarily consent to all terms and conditions herein, and expressly authorize Amado Clinic to process recurring membership payments through the registered credit card in accordance with the selected plan.
